1. Who we are
Buildwise is operated by BUILD WISE AI LTD, a company registered in England and Wales. These terms govern your use of the Buildwise platform at mybuildwise.co.uk. By creating an account or using the platform, you agree to these terms.
2. What Buildwise does
Buildwise uses artificial intelligence to help you prepare planning documents including Design & Access Statements, Lawful Development Certificate statements, Prior Approval statements, and planning appeal statements (written representations). The platform is a drafting aid — it does not constitute professional planning advice, architectural advice, or legal advice. You are responsible for reviewing all generated documents before submitting them to any authority.
3. Permitted Development Checker
The Buildwise Permit PD Checker is a free tool that applies the rules of the General Permitted Development Order 2015 to assess whether proposed works are likely to be permitted development. Its output is advisory only — it does not constitute a legal determination and should not be relied upon as a substitute for professional advice. Buildwise accepts no liability for planning decisions based on PD Checker results. The check is based on the GPDO 2015 as amended (September 2019 technical guidance).
4. Pricing, purchases and billing
- Buildwise Permit (PD Checker) is free to use with no subscription required.
- Design & Access, LDC, Prior Approval and appeal statements can be bought individually (pay as you go) or generated under a monthly plan. A subscription is not required to buy a document.
- Pay as you go. A document credit is charged at the price shown at checkout and is consumed at the moment a finished document is generated. If a generation fails, no credit is used. Because each document is produced to your order as soon as you generate it, a credit that has been used to generate a document is non-refundable. Unused credits do not expire.
- Subscriptions are billed monthly or annually in advance via Stripe.
- You can cancel at any time — your plan remains active until the end of the current billing period, after which no further charges are made.
- Document allowances reset at the start of each new billing period and unused allowances do not carry over.
- “Unlimited” document generation on the Studio plan is subject to fair use. It is intended for the normal professional needs of a single practice and may not be used for resale, bulk or automated generation, or shared across multiple businesses. We may contact accounts with unusually high or atypical usage to discuss a more suitable plan, and reserve the right to apply reasonable limits where usage is clearly inconsistent with normal professional use.
- All prices are in GBP and are exclusive of VAT. Buildwise is not currently VAT registered — no VAT is charged. This will be updated if and when VAT registration is required.
- We reserve the right to change pricing with 30 days’ notice to existing subscribers.
- The price and any offer shown at the point of purchase are the ones that apply. Prices, plans and promotional offers may change at any time. Older prices or offers that remain visible elsewhere — in cached web pages, search results, social media posts, third-party listings or previous correspondence — are not continuing offers and do not bind us.
- Promotional offers may be varied or withdrawn at any time before you purchase, and may be limited in time, in number, or to particular types of customer. Where an offer has conditions, those conditions are stated with the offer.
- If you already pay us, this does not apply to your existing plan without notice. We will give you at least 30 days’ notice before any change to your subscription price takes effect, and you may cancel before it does. Documents already bought are unaffected.
- Obvious errors. If a price is displayed that is clearly wrong, we are not obliged to supply at that price. We will tell you and give you the choice of the correct price or a full refund.
5. Geographic coverage and service limitations
- Document generation is only available for projects located within Local Planning Authority areas supported by Buildwise. A current list of supported councils is available at mybuildwise.co.uk/pricing.
- The list of supported councils may change. Buildwise does not guarantee coverage for any specific Local Planning Authority in perpetuity — we may add or, in exceptional circumstances, remove LPA coverage as our policy database is maintained.
- If your project is located in an unsupported area, document generation features will not be available. The Permitted Development Checker remains available regardless of location.
- You are encouraged to verify that your council is supported before subscribing. If your council is not yet supported at the time of subscription, you may contact us at hello@mybuildwise.co.uk and we will endeavour to advise on expected coverage timelines.
6. Refunds and consumer rights
If you are signing up as a consumer (an individual not acting in the course of a business), you have a 14-day right to cancel under the Consumer Contracts Regulations 2013. If you have already used the service during this period, we may deduct the value of documents generated from any refund.
If you are signing up as a business (an architect, planning consultant, or firm), consumer cancellation rights do not apply. Subscriptions are non-refundable except where we have materially failed to provide the service.

Your content: You retain full ownership of the information, drawings, and project data you upload to Buildwise.
Generated documents:The Design & Access Statements, LDC statements, and other documents generated by Buildwise on your behalf are yours. You are free to use, submit, edit, and distribute them without restriction. Buildwise makes no claim to ownership of your generated documents.
Our platform: The Buildwise software, design, policy database, prompts, and all other platform components are owned by BUILD WISE AI LTD and protected by intellectual property law. You may not copy, reverse-engineer, or redistribute any part of the platform. The Buildwise policy database is protected by copyright and by database right under the Copyright and Rights in Databases Regulations 1997. Extraction or re-utilisation of all or a substantial part of the database, by manual or automated means — including to train or develop any AI or machine-learning system — is prohibited.
Anonymised data: You grant us permission to use anonymised, aggregated data derived from planning outcomes (with all personal identifiers removed) to improve our service, as described in our Privacy Policy.

- We do not sell your data to third parties.
- You can request deletion of your account and data at any time.

9. AI-generated content and disclaimer
- Documents generated by Buildwise are produced by AI and may contain errors, omissions, or inaccuracies.
- You must review all generated content carefully before using it in any planning application or submission.
- Buildwise accepts no liability for decisions made by local planning authorities based on AI-generated documents.
- The platform cites planning policies based on our curated database — you should verify policy references against the current adopted local plan before submission, as local plans are updated periodically.
- Buildwise does not guarantee that any planning application will be approved.
10. Acceptable use
You agree not to use Buildwise to:
- Submit false or misleading information to planning authorities
- Circumvent payment systems or share account access with others
- Attempt to reverse-engineer, scrape, or abuse the platform
- Use the service in any way that violates applicable laws or regulations
- Upload content that infringes third-party intellectual property rights
11. Limitation of liability
To the maximum extent permitted by law:
- Our total liability to you for any claim arising from use of the platform is limited to the amount you paid in the 3 months preceding the claim.
- We are not liable for any loss of planning permission, loss of profit, loss of business, or consequential or indirect damages of any kind.
- We are not liable for the accuracy of third-party planning policy data, constraint data from government APIs, or flood zone information.
12. Service availability
We aim to provide a reliable service but do not guarantee 100% uptime. We may temporarily suspend the service for maintenance, updates, or events outside our control. We will endeavour to give advance notice of planned downtime.
We reserve the right to modify or discontinue any feature of the platform with reasonable notice. We will not remove core features that subscribers are actively using without offering an alternative or prorated refund.

13. Governing law and disputes
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of Buildwise shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to these terms
We may update these terms from time to time. We will notify you by email of material changes at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the new terms. If you do not accept changed terms, you may cancel your subscription before the effective date.
